The 2018-19 The BIG WIN! Arts Raffle of Tucson (“Raffle”) is jointly conducted by and for the benefit of the Tucson Museum of Art (“TMA”) and the Tucson Symphony Orchestra (“TSO”).
Anyone 21 years of age or older may enter the Raffle. Entry purchaser must be present in the state of Arizona at the time of the entry purchase. It is not necessary to be a resident of Arizona, but one must be physically present in Arizona at the time of entry purchase. An affidavit of eligibility may be required from the prize winner. By entering the Raffle, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the Raffle’s rules and regulations.
More than one name may be entered on the ticket to indicate that any prize won is to be shared. Only the names provided on the ticket will be eligible to receive prizes. Entries in person will be accepted at Tucson Symphony Center, 2175 N Sixth Ave, Tucson, AZ 85705 or at Tucson Museum of Art, 140 North Main Avenue, Tucson, AZ 85701. Entries must include payment by cash, check or credit card to be eligible. You may also call TSO at (520) 882-8585 or TMA at (520) 624-2333 with your VISA, MasterCard, Discover or American Express number and expiration date to purchase a ticket. Or you may complete your ticket purchase online at www.tucsonsymphony.org, www.tucsonmuseumofart.org, or www.tucsonartsraffle.com.
Tickets are in electronic form; there are no hard-copy tickets. Each purchaser will receive a receipt in person, or by email if an email address is provided, or if requested, through the mail. Each receipt will indicate a sales confirmation number, the number of tickets purchased, and the amount received for the ticket(s). Receipts and confirmation numbers are evidence of purchase, and are not required to win. You may purchase as many available tickets as you wish. All sales transactions are final. No payments will be refunded. The TMA and TSO reserve the right to reject any entry form that is submitted with payment that does not constitute “good funds.” Only 8,800 tickets will be sold at two price points: single tickets for $125 and 3-packs for $300. Entries received after multi-pack tickets are sold out or more than 5,500 tickets have been sold will be returned to the requesting entrant.
Tickets will not be sold past January 27, 2019 at 4:00 pm; however, tickets may sell out before this time. The winner need not be present to win. After the Early Bird, Holiday Cash and Recovery Cash drawings, the winner’s entry ticket will be returned to the bin for the subsequent Final Drawing. All winners of prizes will continue to have the opportunity to win subsequent prizes, including the Grand Prize.
Drawing dates are:
Early Bird Drawing – Wednesday, November 21, 2018. Entries will be accepted until Sunday, November 18, 2018 at 4:00 pm.
Holiday Cash Drawing – Wednesday, December 16, 2018. Entries will be accepted until Sunday, December 13, 2018 at 4:00 pm.
Recovery Cash Drawing – Wednesday, January 16, 2019. Entries will be accepted until Sunday, January 13, 2019 at 4:00 pm.
Final Drawing – Wednesday, January 30, 2019. Entries will be accepted until Sunday, January 27, 2019 at 4:00 pm. Prize winners will be announced on Monday, February 4, 2019.
The Grand Prize winner must claim their prize within fourteen (14) calendar days of the draw. All other winners must claim their prize within thirty (30) calendar days of the final draw.
Final Drawing – Grand Prize
The Grand Prize winner has the option of receiving either “Prizes and Cash” or “Cash Only” option. The “Prizes and Cash” option awards one of every prize offered from the Raffle (excluding tickets to productions offered by local Tucson arts organizations in the Early Bird drawing) plus twenty-five thousand dollars ($25,000) cash to be paid by TMA & TSO less appropriate and required federal taxes. Vehicle prize conditions and restrictions apply (see Early Bird First Prize Drawing Winner for details). The “Cash Only” option awards Ninety thousand dollars ($90,000) cash to be paid by TMA & TSO less appropriate and required federal taxes.
The Grand Prize winner must make their election in writing before 4:00 pm on February 10, 2019. If the grand prize winner fails to make the election by this deadline, he or she will be deemed to have elected the cash option.
Early Bird First Prize Drawing winner
The Early Bird First Prize winner has the option of receiving the 2019 Cadillac XT4 (with the TSO / TMA paying Royal Automotive Group of Tucson (Royal) the MSRP, plus additional features or options for the selected vehicle, up to and not to exceed $40,000, excluding all related purchase fees and taxes) or $30,000 cash paid by the TSO and TMA less the appropriate and required federal taxes. If the Early Bird First Prize winner elects to take the offered vehicle, the Early Bird First Prize winner assumes responsibility for all related purchase fees and taxes, as well as additional options or features beyond the $40,000 maximum to be paid by the TSO and TMA.
If the vehicle(s) is chosen and subsequently returned to Royal, any amount in excess of $30,000 of the purchased vehicle price provided by the TSO and TMA up to the $40,000, will be refunded directly to the TSO and TMA. Value of the vehicle(s) is based on the manufacturer’s suggested retail price (MSRP). If electing to take the automobile, the Early Bird First Prize winner is required to remit Federal tax withholding to the IRS via Tucson Museum of Art’s Chief Financial Officer (CFO) prior to delivery of vehicle (calculated at 25% of MSRP) which will be sent to the IRS on the winner’s behalf. Should the Early Bird First Prize winner elect to take the vehicle(s) but wish to obtain a different model from Royal, the Early Bird First Prize winner will be responsible for any additional costs associated with the purchase of the other model. If a vehicle with a lesser MSRP is selected, the TSO and TMA will pay the dealership for the cost of the automobile up to the $40,000, but will not reimburse the difference to the Early Bird First Prize winner. If the Early Bird First Prize winner elects to take the $30,000 in cash, 25% will be withheld by the TMA’s CFO and sent to the IRS on their behalf.
By entering this “Raffle,” entrants accept and agree: (i) to be bound by these rules, limitations and restrictions and by the decisions of the Tucson Symphony Orchestra and Tucson Museum of Art; and (ii) their names and likenesses may be disclosed to and used by the news media and may otherwise be used by the TSO and TMA for publicity purposes.
The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar drawings for valuable prizes are not gifts, and therefore do not qualify as deductible charitable contributions. The chances of winning are based on the number of tickets sold. If fewer tickets are sold, the odds of winning the Raffle increase.
With respect to taxable income, for any prizes worth more than $600 AND the payout is at least 300 times the amount of the wager, the value will be reported to the IRS by TMA and TSO via form W-2G and will be taxable to the winner. Also as mentioned above, federal law requires that corresponding tax withholding of 25% on prize values of greater than $5,000 must be collected from winners upon award and distribution. Tax form W-2G will be filed on the winner’s behalf in addition to withheld taxes. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed.
